1. Price

All prices in CHF inclusive 8% value added tax.

2. Validity

We render all deliveries and services on the basis of the following General Terms and Conditions (GTC), in the version valid at the time of the order. These GTC are valid for an unlimited time, as long as they have not been altered by the parties with a written agreement. In all other cases the provisions of OR (Schweizerisches Obligationen Recht) on contract of sale (Kaufvertrag) as well as other Swiss laws and decrees are valid. In the case of an inoperative provision or a gap in these GTC, it will not affect the effectiveness of the remaining provisions. Instead of inoperative provisions an operative provision which is economically closest to the one intended by the parties will be considered as initially agreed.

3. Supply and conclusion of a contract

Our price lists, brochures and publications on the internet are principally without obligation. An offer is valid until revoked, as long as there is not any other written agreement. The contract is accepted with the receiving of the order. In the case of obvious misspellings and miscalculations we are entitled to withdraw from the contract.

4. Delivery and delays

The goods are delivered including the chosen shipping fees to any address in Switzerland or abroad. When delivering abroad the orderer is charged with any additional taxes and customary duties and bound to receive the goods. If we should be out of stock for a certain item, there may be delays of a month or more. In such cases the orderer will be informed and then has the right to place a written withdrawal from the contract within 10 days. We are entitled to partial deliveries and will be charged with any additional delivery costs caused by them.

5. Fulfillment of the contract

For dimension and carrying out of deliveries our confirmation is authoritative. As long as no particular place of fulfillment is agreed by the parties or results from the nature of the trade, the provision of the goods in our distribution center counts as delivery. If not expressly agreed differently, with the dispatch of the goods, benefit and risk pass over from the sender to the orderer.

6. Rights of return and warrantee

The prices are indicated in the offer and in the course of the ordering procedure are without obligation. Delivery is principally only carried out in return for payment by credit card (VISA, EURO-/ MASTERCARD). If the orderer doesn't like our product, he has the right to return it within 10 days by indicating the reason and the order-id. Provided that the product has not been worn (hygienical reasons) or washed (reselling reasons). If the orderer supplies evidence for defects in delivered goods, we will provide the removal of the defects or a substitute delivery within a reasonable amount of time. Should we not succeed in doing so, the orderer may by his/her choice cancel the purchase or have a price reduction. Excluded from guarantee are defects and interference which are beyond our influence, such as natural wear and tear, improper use, interference of the customer or third party, excessive strain or extreme influence of the environment. If the customer further sells the products, he/she is responsible for the adherence to domestic and foreign export conditions. If the customer alters the reselling products, he/she will be liable for resulting damages towards us, the customer and third parties. Reserved are regulations of the Swiss law of product liability (Produktehaftpflichtgesetz).

7. Security and data protection

The confidential data between the orderer and us are coded with reliable SSL-technology. Creditcard data is not saved by us. The registration of this data and the online-transactions are executed by our Partner Saferpay. Additionally, each transaction is authorized and checked online by the credit card company in charge. Blocked or fake cards may not be used. We obligate ourselves not to sell or pass our customer data to third parties.

8. Final provision

Jurisdiction lies with the courts of Basel-Stadt, Switzerland. However we may also appeal to the court of the customer's residence. Swiss Law is applied exclusively, also when orders are placed from abroad or goods delivered abroad. The parties will endeavor to settle any arguments that should arise from the realization of this contract in an amicable way. With the placing of an order the orderer accepts these general trading terms. Alterations or supplementations of the general trading terms are exclusively carried out by us. They must be carried out in written form.
